§ 11-5-3. Tests for unlawful noise.

  • The standards which shall be considered in determining whether a violation of this chapter exists may include, but shall not be limited to the following:

    (1)

    level of noise;

    (2)

    whether the nature of the noise is usual or unusual;

    (3)

    whether the origin of the noise is natural or unnatural;

    (4)

    proximity of noise to residential sleeping facilities;

    (5)

    nature and zoning of the area within which the noise emanates;

    (6)

    density of inhabitation of the area within which the noise emanates;

    (7)

    time of day or night the noise occurs;

    (8)

    duration of the noise;

    (9)

    whether the noise is recurrent, intermittent or constant; and

    (10)

    whether the noise is produced by a commercial or noncommercial activity.
