§ 5-2-2. Construction of curb and gutter upon petition of property owner.

  • (a)

    Upon petition by any property owner, the city shall, subject to planning requirements and to the availability of funds, construct curbs and gutters at the proper lines and at grades to be determined by the director of transportation and environment services in the streets in front of or on the sides of the property of the petitioner; provided, that before such construction is commenced, the property owner will pay to the city 50 percent of the cost of such construction on front yard street frontage and 25 percent of the cost of such construction on side yard street frontage.

    (b)

    This section shall not apply when curb and gutter construction is required by any other law of the city. (Code 1963, Sec. 33-2)
