§ 9-2-12. Permits for flights for distribution of circulars, etc.

  • No person shall make any flights within or over the city carrying banners on any aircraft or distribute circulars from any aircraft within or over the city or operate a loud-speaking device from any aircraft flying within or over the city, without first obtaining a permit to do so from the chief of police and paying a permit fee of $5 for each flight. The chief of police shall issue such permit if the person who will operate the aircraft in carrying out the proposed flight is duly licensed by the Federal Aviation Agency, the aircraft to be used is licensed by the Federal Aviation Agency, and the safety or lives of the inhabitants of the city will not be endangered by the proposed flight. Permits as provided for in this section may be issued by the chief of police for periods of not longer than six (6) months, rather than for individual flights, if the safety or lives of the inhabitants of the city will not be endangered and if a permit fee of $25 is paid; provided, that the permit shall be revoked by the police chief upon violation of any provision of this chapter.
