No transfer shall occur without prior written application to and approval of the city
council, and only then upon such terms and conditions as the council deems necessary
and proper, consistent with applicable law. A franchise is a privilege that is in
the public trust and personal to the franchisee, and the franchisee's obligations
under a franchise involve personal services whose performance involves personal credit,
trust and confidence in the franchisee. Any transfer without the prior approval of
the city council shall be considered to impair the city's assurance of due performance.
The council approval of a transfer in one instance shall not render unnecessary council
