§ 9-3-347. Rights and remedies.

  • (a)

    The rights and remedies provided by this chapter are cumulative and shall be in addition to and not in derogation on of any other rights and remedies which the city, a franchisee or another person may have with respect to the subject matter of this chapter.

    (b)

    The city hereby reserves to itself the right to intervene in any suit, action or proceeding involving any provision of this chapter.

    (c)

    Specific mention of the materiality of any of the provisions herein is not intended to be exclusive of any others for the purpose of determining whether any failure of compliance hereunder is material and substantial.

    (d)

    No franchisee shall be relieved of its obligation to comply with any provision of this chapter by reason of a failure on the part of the city to initiate enforcement action against the franchisee for a violation of the provision. Nor shall any a failure by the city to enforce a provision of this chapter be deemed to waive the franchisee's violation or to void that provision. (Ord. No. 4738, 10/15/11, Sec. 1)
