Notwithstanding any contrary provisions of this chapter, the city attorney shall not
represent either the commission or the director in any matter or proceeding in which
the city or any department, office or agency of the city is a respondent. In this
event, the commission and the director may consult with and retain a private attorney
to provide the services that the city attorney would ordinarily provide the commission
