§ 2-1-26. Interference with appointments, etc.

  • (a)

    Neither the city council nor any of its members shall direct the appointment of any person to or his removal from any office or employment by the city manager or by any of his subordinates, except as specifically provided in the charter. Except for the purpose of inquiry, the city council and its members shall deal with the administrative services solely through the city manager, and neither the city council nor any member thereof shall give orders either publicly or privately to any subordinate of the city manager. Nothing contained in this section shall be construed as prohibiting any councilman from discussing with the city manager any appointment or removal.

    (b)

    Any councilman violating the provisions of this section or voting for a motion, resolution or ordinance in violation of this section shall, upon conviction, be punished as provided in section 1-1-7 of this code. (Code 1963, Sec. 2-26)
