§ 5-6-147. Wastewater discharge permit modifications.

Latest version.
  • (a)

Upon the promulgation of a national categorical pretreatment standard, the authority shall notify all users holding a wastewater discharge permit which may be subject to the new standard. If the new standard is more stringent than corresponding requirements in the permits of such users, the authority shall modify the permits to require compliance with the new standard within the time frame prescribed by the standard. Where a user which becomes subject to a new pretreatment standard does not hold a wastewater discharge permit, the user shall file a completed permit application form with the authority within 90 days after the promulgation of the new standard, unless a federal or state statute or regulation requires that the application be filed within a shorter period of time.

    (b)

A wastewater discharge permit is subject to modification by the engineer as limitations or requirements identified in this division are revised or upon just cause. An industrial user shall be informed of any permit modification at least 30 days prior to the effective date of the modification, unless federal or state law or regulation requires an earlier effective date. Any modification in a permit shall include a reasonable time schedule for compliance. (Ord. No. 4501, 10/13/07, Sec. 1)
